Musk Seeks AI CEO Ouster in Lawsuit
8 Apr
Summary
- Musk seeks removal of Sam Altman and Greg Brockman from OpenAI.
- Musk claims OpenAI deceived him into donating $38 million.
- Jury selection starts April 27 for the fraud case in California.

Elon Musk is seeking the removal of OpenAI CEO Sam Altman and President Greg Brockman as officers in a legal case expected to go to trial later this month. Musk's lawyers have outlined specific remedies sought if a judge determines Altman and OpenAI defrauded Musk, who helped start the AI company nearly a decade ago.
Musk sued Altman and OpenAI in 2024, alleging deception regarding its nonprofit status and a donation of $38 million. He is now asking a court to remove Altman from the OpenAI nonprofit board and both Altman and Brockman as officers of the for-profit entity. Musk also wants OpenAI to revert to operating solely as a nonprofit.
Jury selection for the trial is scheduled to commence on April 27 in federal court in Oakland, California. This legal battle follows OpenAI's recent communication urging state attorneys general to investigate alleged "improper and anti-competitive behavior" by Musk and his associates.
Musk, Altman, and others co-founded OpenAI as a nonprofit AI lab in 2015. Musk departed in 2018 and later launched a competing company, xAI. OpenAI, in turn, has accused Musk of working to undermine the company through "attacks" and coordination with other tech leaders.
