Summary
- Company ordered to refund Rs 1.75 lakh membership fee.
- Consumer awarded Rs 1 lakh for mental agony and Rs 50,000 costs.
- Firm failed to issue membership card and allot promised plot.

The Delhi State Consumer Disputes Redressal Commission has ordered a hospitality and holiday membership company to refund Rs 1.75 lakh in membership fees. The company must also pay Rs 1 lakh for mental agony and Rs 50,000 for litigation costs, totaling Rs 3.25 lakh.
The commission found the company deficient in service for failing to issue a membership card and allot a promised plot. These failures prevented the consumer from accessing promised holiday benefits.
In April 2008, the complainant paid Rs 1.75 lakh for a lifetime holiday membership, which included a plot along the Mumbai-Goa Highway. He never received his membership card or the plot.
The company had argued the fee was non-refundable and that the plot required additional payments. However, the commission ruled the company couldn't rely on such conditions without fulfilling its primary obligations first.
The commission criticized companies that attract consumers with lucrative offers but fail to deliver, emphasizing consumer protection laws safeguard against such practices.
