Chandigarh Property: Old GPA Power Restored?

Summary
- Policy regularizes properties via power of attorney before 2011.
- Supreme Court ruling in 2011 impacted property transfer rules.
- New policy excludes new power of attorney property transactions.
Chandigarh's administration has finalized a policy to regularize properties acquired through power of attorney (GPA/SPA) transactions completed before October 11, 2011. This move aims to provide relief to hundreds of property owners facing ownership issues following a 2011 Supreme Court judgment. The ruling stated that GPA alone does not transfer property title, necessitating a registered conveyance deed.
Over 200 applications are currently pending with the Chandigarh Housing Board and the Estate Office. The proposed policy, awaiting final approval, could establish a formal process for these long-standing cases. However, the relaxation is strictly limited to pre-2011 transactions and will not cover any new property deals made using power of attorney.
This initiative could help families who have possessed properties for years but struggled to update ownership records. Formalizing these old GPA-based transactions will simplify subsequent transfers, sales, or inheritance processes once ownership is officially recognized.
