This structure, critics argue, significantly reduced the overall increased usage capacity users believed they were purchasing.
The complaint highlights user frustration, with one Reddit user comparing the restrictive weekly allowance to a large gas tank with a severely limited fuel pump. This alleged misrepresentation has led subscribers to feel they are not receiving the value they paid for.
The lawsuit was initially filed in July, then withdrawn and refiled as an expanded class action. Anthropic had previously argued in a motion to dismiss that clarifying information was accessible via hyperlinks, comparing it to reading a product's back label, a claim Vaca disputes due to the complexity for average consumers.
This legal challenge comes as AI companies face increasing pressure to turn profits. Anthropic introduced the Max plan in April 2025, but allegedly implemented the restrictive weekly limits in August 2025, as it vied for market share with OpenAI. The company later hinted at addressing customer price concerns in its latest model release.
