A Division Bench of the court upheld a single judge's earlier decision. The bench concluded that Bhatia had not sufficiently proven that her photographs were utilized beyond the contractual period, which ended in October 2009.
Bhatia had claimed that Power Soaps continued to use her images on product packaging, advertisements, and online platforms from 2010 to 2011, despite the agreement's expiration. She argued this misuse affected her professional prospects.
However, the court found the evidence presented, including product wrappers and online listings, lacked reliability. Consequently, both the single judge and the Division Bench dismissed her claims due to a lack of credible evidence supporting the alleged misuse.
