The Banyan, a Frederick restaurant, is seeking conditional-use approval for amplified live music on its rooftop. The owners, Dan and Staci Caiola, wish to offer entertainment until 9 p.m. on Sundays through Thursdays and until 10 p.m. on Fridays and Saturdays. Indoor entertainment is requested until midnight, with occasional later special events.
However, the restaurant's request faces opposition from several neighbors. Residents have submitted comments to the city detailing how amplified music from the rooftop has been audible inside their homes and yards, disrupting peace and quiet. Some have reported hearing music through closed windows and experiencing vibrations.
In response to the complaints, the Caiolas state they have adjusted the speaker system, improved soundproofing, and increased management's control over performer volumes. They maintain the intention is for light entertainment, not a concert venue, and believe the sound can be contained effectively.
Musicians who have performed on the rooftop acknowledge that the initial setup was louder than anticipated at street level. They confirm that after changes were made to connect performers to a controlled system, the volume became reasonable. Police have engaged with The Banyan's management regarding noise concerns.
The city's planning staff has recommended approving the request with the proposed restrictions. A zoning board hearing on Tuesday, July 29, 2026, will deliberate on the matter, with potential for additional conditions to be imposed.
