Devin Kim, a former engineer at Elon Musk's xAI, has initiated a lawsuit against the company and its parent, SpaceX, alleging he was terminated for highlighting AI safety concerns.
Kim's suit, filed in a California state court in September 2025, asserts that his employment was ended after he repeatedly complained about xAI's alleged failure to prioritize safety in the development of Grok, the company's AI chatbot. He expressed particular concern that Grok could incite discrimination and facilitate the dissemination of information regarding weapons of mass destruction.
According to the complaint, Kim's supervisor, xAI co-founder Jimmy Ba, is accused of ignoring Musk's directives on safety and retaliation against Kim. Ba allegedly opposed AI safety measures, prioritizing the race for superintelligence over potential risks and safety regulations, even attempting to circumvent EU safety regulations during Grok Code 1's release.
Kim, who has a history of working on AI safety initiatives, was reportedly dismissed without a satisfactory reason shortly before he planned to present his findings. He is seeking compensatory and punitive damages, along with a judgment declaring the conduct of xAI and SpaceX unlawful.
