WhatsApp Encryption Lawsuit Dismissed: Claims Lack Evidence
25 Jul
Summary
- Judge dismissed lawsuit alleging WhatsApp bypasses encryption.
- Lack of evidence and technical details led to dismissal.
- Plaintiffs have until August 13 to file an amended complaint.

A lawsuit claiming WhatsApp could bypass its end-to-end encryption has been dismissed by a US District Judge. The judge cited a lack of evidence and insufficient information regarding the basis of the whistleblowers' claims.
The original complaint alleged that WhatsApp and Meta employees could access user messages through an internal IT process, rendering the encryption a sham. However, the judge stated the complaint lacked the necessary "who, what, when, where, and how" details of the alleged misconduct.
Despite the dismissal, the plaintiffs have until August 13 to file an amended complaint correcting these deficiencies. The judge noted that Meta's evidence did not conclusively rule out the possibility that WhatsApp could theoretically access unencrypted chats. A cybersecurity expert also testified that it's theoretically possible for WhatsApp to access user chats without user permission, though further analysis is needed.
WhatsApp has called the lawsuit "categorically false and absurd," stating it was based on a misunderstanding of an internal system for reviewing reported abuse. The company remains confident that the allegations are baseless.
