Zilis' Testimony Rocks Musk-OpenAI Court Battle
8 May
Summary
- Shivon Zilis was a key informant between Musk and OpenAI leadership.
- Musk sues OpenAI, alleging deception and breach of trust.
- Zilis' personal relationship with Musk impacted her board role.

Shivon Zilis, a former OpenAI board member and mother to Elon Musk's twins, testified this week amidst a significant legal battle. She served as a crucial link, facilitating information flow between Musk and OpenAI's leadership until Musk launched his own AI company, xAI, in 2023.
Musk initiated the lawsuit against OpenAI, asserting that the company misled him, violated a charitable trust, and unjustly enriched itself by transitioning from a nonprofit to a for-profit structure. Zilis, initially a co-plaintiff, withdrew her involvement before the trial commenced at her request.
OpenAI denies Musk's allegations, counter-arguing that Musk himself advocated for a for-profit entity. The company also suggests Musk's lawsuit stems from his inability to gain complete control over OpenAI after his departure in 2018.
Evidence presented, including text messages, indicated Zilis resigned from the board due to Musk's plans to start a competing AI venture and recruit from OpenAI. Despite her claims of prioritizing AI's benefit to humanity, her testimony addressed her personal relationship with Musk, which OpenAI president Greg Brockman was initially unaware of.
Musk, who described Zilis as a senior adviser and "chief of staff," also referred to her as his "partner." Their relationship began as a "one-off" romantic encounter in 2016, evolving into friendship and professional roles, culminating in Zilis bearing his children. She testified that her relationship did not compromise her board duties, though her views on OpenAI shifted after Musk's criticism of a Microsoft investment and Nadella's role in restoring Altman as CEO.
