The complaint specifically names Meta's management, subsidiaries of spectacles maker EssilorLuxottica, and retailers like Fielmann, Apollo-Optik, Mister Spex, and MediaMarkt.
The legal challenge is rooted in a federal digital data protection law that forbids the distribution of communication devices engineered for clandestine filming. Germany's Federal Network Agency previously stated in late 2023 that connected devices for covert audio or video recordings are prohibited, though they are monitoring the market.
The agency clarified that owning, importing, or selling smart glasses is not banned, provided the recording function is clearly visible, such as through an optical signal. This action follows reports in July of a Hamburg-based state privacy agency taking legal steps against the use of smart glasses.
