A Florida woman has secured a $7 million settlement following a missed cancer diagnosis, which led to an eight-month delay in treatment. Deborah Higgs discovered a lump in February 2022 and was initially informed by a radiologist that her diagnostic mammogram and ultrasound showed no issues.
By October of the same year, the lump had grown, and a subsequent review of the imaging data revealed a "high suspicion for malignancy." This resulted in Higgs being diagnosed with terminal Stage 4 breast cancer, leaving her in disbelief and anger over the perceived lapse in care.
Higgs pursued legal action against Baptist Medical Center and Acumen Medical Imaging and Interventional. While the hospital initially cited waivers signed by Higgs, a judge allowed a jury to consider the hospital's communication control. Ultimately, a settlement was reached, with Baptist Health Care contributing $5 million and Acumen Medical Imaging $2 million.
As part of the agreement, Baptist Health Care will provide clearer documentation to patients, advising follow-up even with normal results. The radiology group will also implement a policy allowing women with breast lumps to meet with radiologists. Higgs stated her primary victory was empowering other women in their healthcare decisions.
