Plasma Donor Sues Over Kidney Injury Claim
12 Mar
Summary
- Man claims acute kidney injury from July 2023 plasma donation.
- Company disputes claims, citing informed consent and pre-existing conditions.
- Lawsuit alleges machine error returned broken red blood cells.
A lawsuit filed in July 2023 alleges a plasma donor suffered an acute kidney injury following a procedure at a Grifols facility in Winnipeg. The plaintiff claims a machine error occurred during his donation, leading to broken red blood cells being returned to his body along with the plasma. This allegedly resulted in flu-like symptoms, blood in his urine, and significant abdominal pain, requiring hospitalization.
Canadian Plasma Resources, operating as Grifols, has filed a defense statement asserting the man was fully informed of the risks and provided his consent before the procedure. The company notes the plaintiff had donated plasma at the facility at least 12 times previously. They deny negligence, stating the procedure was conducted safely and in accordance with regulations.
While denying the plaintiff's claimed injuries, the company alternatively states that if any injury occurred, it was not caused by their actions or omissions. Instead, they attribute the cause to the plaintiff's pre-existing or unforeseen medical conditions. The lawsuit further claims the man suffered permanent injuries and experienced fatigue preventing him from returning to work for approximately a month.
