FDA Lets Juul Vapes Stay: Teens Fumed, Adults Cautiously Optimistic
6 May
Summary
- FDA allows Juul e-cigarettes to remain on the market.
- Juul studies suggest products are less harmful for adult smokers.
- Decision faces opposition from parents and anti-tobacco groups.

The U.S. Food and Drug Administration (FDA) has permitted Juul e-cigarettes to remain available for adult smokers. This decision follows years of struggle for the vaping brand, which was heavily criticized for its role in the teen vaping surge. FDA regulators indicated that studies submitted by Juul suggest the products could be less harmful for adult smokers looking to transition away from traditional cigarettes.
This authorization applies to both tobacco and menthol-flavored reusable Juul products, excluding the fruit and candy flavors previously discontinued due to youth appeal. Juul will now be one of only two companies with FDA authorization for menthol vapes, a flavor favored by many adult smokers. The company's CEO expressed optimism about this milestone and the scientifically backed case for menthol's role.
Despite this regulatory relief, the FDA's decision is anticipated to draw significant opposition from parents, politicians, and anti-tobacco organizations. These groups have long argued for a permanent ban on Juul products, citing their contribution to a public health crisis of underage vaping. The Campaign for Tobacco-Free Kids has voiced strong disapproval, calling the authorization a step in the wrong direction.
Juul, once valued at over $13 billion, has faced substantial challenges, including job cuts and billions paid to settle lawsuits over its impact on youth vaping. The FDA had initially ordered Juul products removed from the market in June 2022 but later reopened its scientific review after the company contested the decision. The FDA emphasized that the current determination is not an endorsement and that non-smokers should avoid e-cigarettes.
