India's Organ Donation Crisis: Thousands Die Waiting

India's organ transplantation efforts are significantly hampered by legal and procedural challenges, resulting in a dire shortage of donor organs. The nation's deceased donation rate remains critically low at 0.77 per million population, a fraction of the rates seen in countries like Spain, which records 49.38 per million.

Key issues include legal uncertainties surrounding the certification of Brainstem Death (BSD) and the process for obtaining consent for organ donation. Ambiguities exist on whether BSD is legally equivalent to cardiac death and when consent should be sought, leading to delays and missed opportunities for transplants. The existing laws are deemed sufficient but require clearer implementation.

Amendments are proposed to streamline BSD certification in all hospitals with Intensive Care Units, not just registered transplant centers, to expand the donor pool. Addressing these ambiguities and bureaucratic hurdles is crucial to save thousands of lives lost annually due to the organ scarcity.
