Maternity Staff Sue Hospital Over Gas Exposure
18 May
Summary
- Over 100 maternity staff sue hospital trust for gas exposure.
- Staff report fatigue, anxiety, and brain fog symptoms.
- Independent review cited delayed response to risks.
Over 100 maternity staff members, including midwives and healthcare assistants, have initiated legal action against the Mid and South Essex NHS Foundation Trust. The lawsuit stems from alleged exposure to high levels of nitrous oxide at Basildon University Hospital's maternity unit between 2018 and 2023. Affected staff report experiencing symptoms such as fatigue, anxiety, headaches, and cognitive issues described as 'brain fog'.
An independent review conducted two years ago highlighted significant failings by the trust. It concluded that the trust "failed to act with candour" and exhibited an "unacceptable delay" in responding to concerns about dangerously elevated nitrous oxide levels. The review stated that these risks should have been treated with greater urgency when reported in July 2021, with mitigation only beginning in October 2022.
The trust's chief executive acknowledged the unacceptable delay in addressing the issue, stating that while robust systems are now in place to ensure safe nitrous oxide levels, the time taken to act was not acceptable. He offered a sincere apology to the affected staff for the prolonged delay and thanked them for their continued commitment to patients.
