Doctor's Negligence Leads to Rs 2 Lakh Payout for Patient
28 Aug
Summary
- Patient suffered persistent bleeding and urinary blockage post-surgery.
- Discrepancies in medical records led to commission's suspicion.
- Doctor referred patient to a higher center only after condition worsened.

A district consumer commission in Haryana recently ruled a doctor negligent in a kidney stone patient's treatment. The patient, Gurjit Singh, experienced persistent bleeding, blood clots, and urinary blockage following surgery on March 11, 2023, and a subsequent procedure on March 26, 2023. His condition deteriorated, leading to a referral to Batra Hospital in Delhi on April 7, 2023, where a pseudoaneurysm was identified and treated.
The commission highlighted unexplained discrepancies between the initial surgical procedure descriptions (RIRS) and later documentation (PCNL and DJ stenting). It found that Singh's precarious condition, evidenced by contemporaneous medical records from Batra Hospital, confirmed continued bleeding and urinary stoppage. The doctor's delay in referring Singh to a higher center equipped for angio-embolization was also deemed negligent.
Rejecting the need for expert evidence in all such cases, the commission stated that each case must be judged on its facts. The doctor was found negligent both in performing the surgery and in the delayed referral. The patient was awarded Rs 2 lakh compensation for mental pain, harassment, and financial loss, to be paid by the doctor's professional indemnity insurer within 45 days.
