NGT Dismisses Sand Mining Appeal Over Delay

The tribunal determined that the appeal was filed 178 days after the initial clearance was cancelled on December 22, 2024, rendering it inadmissible due to exceeding the 90-day statutory limit for delay condonation.
The environmental clearance, initially granted on November 18, 2022, to Vipin Kumar Saxena, was revoked by the State Level Environment Impact Assessment Authority due to significant non-compliance with its conditions. This non-compliance was confirmed by a joint committee report.
Furthermore, the tribunal dismissed the appellant's assertion of not having received the cancellation order, noting that communications were served via registered post, email, and public portal. The appeal was filed well beyond the 30-day window for challenging the subsequent rejection of the restoration plea, despite an opportunity granted by the tribunal.
