At York Magistrates' Court on March 26, 2026, Fortune received a 12-month prison sentence, suspended for two years. He was also fined £2,500 for breaching an unrelated suspended sentence, ordered to pay £10,000 in costs, and a £187 victim surcharge.
He must clear all waste from the site within two years, facing further court proceedings if he fails. The Environment Agency highlighted his disregard for the law and community, emphasizing a crackdown on waste crime.
