Uttarakhand HC: SC Caste Status Valid for PG Medical Admissions
3 Nov
Summary
- Uttarakhand High Court grants SC reservation benefits for PG medical admissions.
- Candidates need valid SC certificate and state residency for benefits.
- Students completing MBBS outside Uttarakhand still eligible for reservation.
The Uttarakhand High Court has established that candidates seeking admission to postgraduate medical courses in the state are eligible for Scheduled Caste (SC) reservation benefits. This entitlement is contingent upon possessing a valid SC certificate issued by a competent state authority and maintaining permanent residency in Uttarakhand.
A division bench, comprising Acting Chief Justice Manoj Kumar Tiwari and Justice Subhash Upadhyay, delivered this verdict. The ruling addressed a petition filed by Yugendra Kumar Singh, a resident of Haridwar, who had alleged denial of reservation benefits despite holding a valid SC certificate and being a permanent resident.
The court accepted the argument that Singh should not be deprived of his category benefits solely because he completed his MBBS from an institution outside Uttarakhand. Consequently, the state counselling board was directed to verify the petitioner's caste certificate and domicile status. If both are deemed valid, the benefit of SC reservation for admission to PG medical courses across Uttarakhand must be provided.
