College Must Refund ₹3.3 Lakh Over NEET Cut-off Issue
28 Sep
Summary
- Student's admission was cancelled due to falling below the NEET cut-off.
- The medical college was ordered to refund the full tuition fee amount.
- The court ruled the fee could not be retained for an unfulfilled admission.
In a recent directive on September 22, the Telangana High Court mandated Guru Nanak Homoeopathic Medical College and Hospital to reimburse ₹3.3 lakh to a student. This decision came after the student's admission to a BHMS course was rescinded.
Student Shabari Priya was initially granted a management-quota seat by Kaloji Narayana Rao University of Health Sciences (KNRUHS) and paid the full tuition fee. However, KNRUHS cancelled her admission on January 23, 2026, citing her NEET score of 128, which was below the required 144.
The student's counsel argued that she should not suffer financially due to an error by the authorities in granting the allotment. The court acknowledged that once the university allotted the seat, the college permitted enrollment, and the fee was paid, the student should not forfeit the amount after admission cancellation.
Irrespective of the cancellation's validity, the court concluded that the institution could not retain tuition fees for a seat the student was ultimately disallowed from continuing. The college has been ordered to refund the entire ₹3.3 lakh within six weeks.
