Tragedy struck at Rooks Park in Washington state when a 3-year-old boy, Kaleb Ortega, was killed after a large stone monument toppled onto him. The incident occurred on April 1 while Kaleb was at the park with his father and sister.
His parents have since initiated legal action against multiple companies involved in the monument's creation and installation. The lawsuit contends that the monument, commemorating Captain Albert H. Rooks and the USS Houston, was overly heavy and lacked adequate support, causing it to fall rapidly and fatally crush Kaleb.
First responders transported Kaleb to a hospital, but he succumbed to his injuries. The situation was made more agonizing as Kaleb's mother, a nurse, was on duty at the hospital and witnessed the attempts to save her son, leading to severe emotional distress for her and the family.
A GoFundMe campaign was established to support the grieving family, remembering Kaleb as a joyful child with a love for monster trucks. The lawsuit further alleges negligence in the monument's design, construction, and maintenance, and that park visitors should have been warned of the risks. Rooks Park was temporarily closed and the monument removed following the incident. The US Army Corps of Engineers operates Rooks Park.
