A recent tragedy has led to a lawsuit alleging severe safety failures on a carnival ride. Clayton Phillips, 13, was killed last month after being ejected from a "Yo-Yo" amusement ride.
The estate of Phillips claims that Midway West Amusements operated the ride knowing that at least 10 chairs were missing essential safety components, including pelvic safety belts, clips, and connectors. Despite this deficiency, the company allegedly instructed employees to manage the ride using only verbal guidance and memory to keep the unsafe chairs empty.
During the incident, Phillips was seated in a compromised chair. The lawsuit states he was thrown or fell from the moving ride, sustaining fatal injuries from the substantial height of his fall. The lawsuit names Midway West Amusements, ride inspection company Shady Acres Safety Services, its owner Dennis Sutherland, and the government of Butte-Silver Bow as defendants, alongside numerous unidentified individuals and entities.
