Parents Sue Surrogate Over Baby's Life-Saving Surgery
20 Aug
Summary
- Surrogate refused abortion for baby with severe heart defect.
- Biological parents filed a $100,000 lawsuit against the surrogate.
- Baby underwent life-saving heart surgery after birth.

A surrogate, McKenna West, is facing a lawsuit seeking over $100,000 from the biological parents, Nausheen Gilkar and Omar Ahmed, after she refused their request to terminate a pregnancy. The baby was diagnosed with hypoplastic left heart syndrome (HLHS), a severe congenital heart defect, around 20 weeks gestation.
Despite the diagnosis and the biological parents' alleged request for abortion, West refused and traveled to Texas to give birth on August 12, 2026. The parents claim West breached their surrogacy agreement, for which they had paid $60,000. They are seeking damages for emotional distress and her alleged "malicious, outrageous conduct."
The child, whom West calls "Gabriel" and the biological parents call "Rumi," underwent a Norwood procedure, the first of three surgeries for HLHS, on August 18, 2026. His condition remains critical. Legal disputes have unfolded across multiple states, with state and federal officials intervening to ensure the child received necessary medical care.
West denies wrongdoing and is seeking dismissal of the counterclaims. Pro-life advocates have rallied behind her, condemning the lawsuit as retaliation. A hearing in the Texas case is scheduled for August 25, 2026.
