Household Names Face Millions in Legal Costs

A group of seven prominent figures, including the Duke of Sussex and Sir Elton John, are facing substantial financial consequences after losing their legal action against Associated Newspapers Limited (ANL). The High Court has ordered them to address the costs associated with the lawsuit.

ANL's legal costs have reportedly surpassed £34 million. The claimants, who alleged unlawful information-gathering, had their cases dismissed entirely earlier this year. Arguments concerning potential appeals have been postponed until financial matters are settled.

The claimants' lawyers argue against paying ANL's costs on an indemnity basis, a stricter method that would maximize recovery for the publisher. This basis could leave the group with millions in costs exceeding their £16.2 million insurance coverage.

Lawyers for ANL contended that the litigation was pursued for a "collateral purpose" aimed at pressuring the government, rather than being ordinary legal proceedings. They highlighted a press release from October 2022 as a "monstrous thing to publish" intended to cause maximum damage.

ANL's legal team also criticized the breadth of the allegations, suggesting the claimants cast a "strikingly wide" net in the hope of finding evidence. The claimants' representatives countered that their actions were honest and in good faith, and that their claims had merit and were not speculative.

A decision on the basis of ANL's costs is expected from Mr Justice Nicklin after the hearing concludes.
