Andrea Mauk experienced a parent's worst nightmare when her 18-year-old son, Damon, died in a car crash on June 24, 2023, in Lucas, Ohio. While vacationing in Costa Rica, she was informed of his tragic death. Upon returning home, she uncovered a second layer of trauma: portions of Damon's body, including his eyes, had been taken as anatomical gifts without her authorization.
Mauk, who was her son's primary emergency contact, was never notified by the hospital. Consent for the organ and tissue donation was obtained from Damon's biological father, a man with minimal involvement in his life. This occurred despite Damon not being a registered organ donor.
Distraught and determined, Mauk is now advocating for 'Damon's Law' to mandate stricter protocols for tissue and organ donation. She testified before the Ohio Senate and pursued a public records case to the Ohio Supreme Court, contributing to new transparency laws in the state.
This advocacy follows a U.S. Department of Health and Human Services investigation in July 2026 that exposed disturbing practices within the organ transplant system, particularly concerning an organization operating across Kentucky, West Virginia, and Ohio. The probe revealed potential issues including inadequate neurological assessments and dubious consent practices.
