A tragic accident on the Dwarka Expressway has resulted in a substantial compensation award, with a Delhi Motor Accident Claims Tribunal granting Rs 1.38 crore to the family of a 32-year-old engineer. The engineer, Kaushal Mishra, passed away ten days after sustaining critical injuries in a collision with a car on December 11, 2022.
The tribunal's ruling emphasized that the accident was a direct consequence of the car driver's rash and negligent actions. Eyewitness testimony supported the finding that the offending vehicle had been traveling on the wrong side of the road. Crucially, the tribunal dismissed the insurance company's defense, which alleged the deceased engineer was solely at fault.
The compensation package encompasses various components, including loss of dependency, medical, and funeral expenses, alongside loss of estate and consortium for the four claimants who relied on the deceased. The insurer, TATA AIG General Insurance Co Ltd, has been directed to deposit the awarded amount.
