Justice Farjand Ali presided over the case, addressing the plea of a prisoner whose severe and multiple ailments necessitated immediate medical attention and familial support. The court noted that the prisoner's continued incarceration, given his grave comorbidities and advanced age, was contrary to the constitutional ethos of dignity and humane treatment.
The petitioner, Ramdin, currently serving his sentence at Central Jail Jodhpur, suffers from coronary artery disease, acute coronary syndrome, kidney ailment, and Type II Diabetes. His legal counsel highlighted that his fragile health and chronic, potentially life-threatening conditions required specialized medical supervision and emotional support from his family.
The court acknowledged the prisoner's precarious medical state, stating that the enumerated ailments were serious and concerning, especially for an individual of advanced age. The ruling underscored that parole, while regulatory, is also guided by reformative and humanitarian principles, ensuring a compassionate approach to correctional jurisprudence.
