The PSNI stated that while they do not accept liability for the case, they acknowledge that the investigation into the killing did not meet expected standards. They recognized that these shortcomings brought additional distress to the family. An inquest into the killing, which began in 2024, was halted due to issues surrounding withheld security information. Mr. McCusker's mother had sued the police, alleging negligence and misfeasance in public office. The terms of the settlement include undisclosed damages, which the family's solicitor described as significant and satisfactory. Mr. McCusker's nephew called the police apology "mediocre," but the judge commended the parties for reaching a resolution that can provide closure, stating it strengthens public confidence. Despite arrests, no one has been prosecuted or convicted for the murder, which occurred behind a youth club in Maghera shortly after Mr. McCusker returned from working in America.
