Baby's Death Trial Begins: Parents Face Murder Charges
5 Mar
Summary
- Mother and partner charged with second-degree murder in infant's death.
- Trial began Tuesday with opening submissions from the Crown.
- Police found the seven-week-old unresponsive with visible bruising.
The joint trial for Boravy Buth and Patrick O'Connor, accused in the death of a seven-week-old boy, commenced on Tuesday at the Ontario Superior Court of Justice. Both face second-degree murder charges, with Buth also accused of criminal negligence causing death. They have both pleaded not guilty and are currently at liberty.
Opening submissions from the Crown alleged that the infant died on Oct. 26, 2021, after an attack. Police were dispatched to an Ottawa residence that morning to reports of a baby not breathing. The first officers on the scene, Constables Stefan Kubiseski and Jordan Blonde, observed bruising on the infant and noted a change in his skin tone.
Kubiseski testified that Buth claimed the baby had fallen from a bed earlier that morning and was later found not breathing by O'Connor. The child was transported to hospital, where he was pronounced dead. The court heard emotional testimony from Kubiseski, who recalled the scene and Buth's distress.
Constable Blonde also testified, stating he found O'Connor performing CPR on the child, who felt cold to the touch and exhibited injuries. Both constables confirmed the infant had no pulse. The trial is scheduled to continue for eight weeks.
