Court Quashes Truck Registration Suspension Over Sand Transport
30 Mar
Summary
- Orissa High Court overturned an RTO order suspending Hyva truck registrations.
- The court found no evidence to justify suspension under Section 53 of the MV Act.
- Vehicle owners depend on the trucks for their livelihood, the court noted.

The Orissa High Court has annulled an order issued by the Jagatsinghpur Regional Transport Officer (RTO) that suspended the registration certificates of several Hyva trucks. This decision came after a batch of petitions was considered by Justice B.P. Routray.
The RTO had suspended the registrations, originally set to expire on March 31, 2026, following the seizure of 46 Hyva trucks and three excavators on November 27, 2025. These vehicles were allegedly involved in illegal sand transportation from the Kilipal Sairat source in Jagatsinghpur district.
Justice Routray declared the RTO's suspension order to be illegal and unauthorized, stating that the authority lacked jurisdiction to take such action without statutory violations. The court found no evidence to support the invocation of Section 53 of the Motor Vehicles Act, particularly subsections (1)(a) or (b), noting that the vehicles possessed valid permits at the time of seizure.
The court highlighted that the petitioners depend on these vehicles for their livelihood and that while illegal sand transportation might be actionable under other laws, it did not constitute a violation of the conditions specified under Section 53 of the Motor Vehicles Act.
