Son Evicted for Abusing Elderly Father in Mumbai

The Bombay High Court has confirmed the eviction of a 52-year-old son from his elderly father's residence in Kalina, Mumbai. This decision, made on August 27, 2026, stems from allegations of repeated abuse and assault against the father. Justice N J Jamadar highlighted that the son's reprehensible conduct critically jeopardized the senior citizen's right to a normal, peaceful, and dignified existence.

The father, 83, initiated proceedings under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. He alleged an abusive temperament, alcoholism, and pressure to transfer properties. Police complaints were filed in July 2022 and February 2023, with supporting CCTV footage and medical records presented as evidence. The son denied these claims, attributing them to sibling disputes.

The high court emphasized the Act's role in protecting senior citizens, stating that eviction is a valid recourse when a child's actions make peaceful occupation impossible. The court dismissed the argument that limited police complaints indicated falsity, noting parents often exhaust other options before seeking legal intervention. The court found no reason to overturn the eviction orders, which had already been implemented, restoring peace to the father's life.
