Summary
- Pathology reports signed by deceased doctor were found.
- Illegal diagnostic labs operate across Maharashtra.
- Court directed state response to regulatory suggestions.
Allegations of widespread illegalities in Maharashtra's diagnostic laboratories have reached the Nagpur bench of the Bombay High Court. The court is currently hearing a criminal public interest litigation concerning unauthorized pathology labs operating across the state.
During a recent hearing, Dr. Rajeev Joshi, representing the Medico Legal Society of India, was permitted to intervene. He presented evidence, including pathology reports bearing the signatures of a doctor who had passed away years prior. Concerns were also raised about laboratories allegedly operating in Kalyan, Ambivali, and Dombivli.
The court has directed the state government to file an affidavit responding to Dr. Joshi's suggestions for addressing these issues. The Public Interest Litigation, which points to thousands of laboratories allegedly operated by technicians with DMLT or CMLT qualifications instead of qualified medical professionals, is scheduled for further hearing on September 15.
The judges emphasized the seriousness of the matter, noting its direct connection to public health and the government's failure to take effective action. The proposed Maharashtra Clinical Establishment Act, 2026, is also under scrutiny regarding its potential to resolve these concerns.
