Mother Sues Over Daughter's Torture Death
10 Jul
Summary
- Jor'Dynn Duncan died from infection due to over 90 injuries.
- Mother sues county and school for alleged neglect and failure to report.
- Guardian charged with murder; others face manslaughter and unlawful imprisonment.

A mother is suing Suffolk County and the Bayport-Blue Point School District following the tragic death of her 7-year-old daughter, Jor'Dynn Duncan, in December 2025. The autopsy revealed Jor'Dynn died from a massive, untreated infection resulting from more than 90 injuries found on her body.
Portia Duncan alleges that Suffolk County neglected her daughter by placing her with legal guardian Emily Kelly, who is accused of physical abuse, neglect, and torture. Kelly faces a second-degree murder charge and pleaded not guilty. Her mother and daughter were also arrested on related charges.
The lawsuit further claims the Bayport-Blue Point School District failed to report indicators of abuse, despite Jor'Dynn's extensive absences and visible injuries. Jor'Dynn allegedly missed 40 school days in 2025 and wore makeup to conceal injuries. Kelly reportedly fabricated excuses for her absences.
Kelly gained full custody of Jor'Dynn in April 2025. Evidence of abuse was reportedly found on Kelly's cell phone. Attorneys for Portia Duncan stated the placement and subsequent lack of supervision and reporting led to Jor'Dynn's death, vowing to hold those responsible accountable. Kelly's defense attorney maintains her client's innocence.
