Kerala HC: Maligning Women's Character is Social Violence

The Kerala High Court has characterized the malicious character assassination of women as a severe form of social violence. Justice CS Dias made these observations while overturning an FIR filed against Malayalam film actor Shwetha Menon.
The court noted that the timing of the complaint suggested a vexatious and mala fide intent, aimed at preventing Menon from contesting for the Association of Malayalam Movie Artists (AMMA) presidency.
Analyzing the case, the High Court concluded that the alleged offenses were not substantiated by the provided materials. The court emphasized that progressive societies judge individuals by their actions and contributions, contrasting them with regressive ones that resort to slander.
Furthermore, the High Court stated that a society that obsesses over a woman's image rather than her accomplishments demonstrates a lack of intellectual depth. The court also clarified that empowering women means recognizing their individuality and achievements with dignity, not demanding sainthood.
The FIR, lodged under the IT Act and Immoral Traffic (Prevention) Act, was deemed to contain sweeping and unsubstantiated allegations insufficient to prove the accusations against Menon. The actor had argued that the films and advertisements in question were legally certified and had been in the public domain for years.
