A special court in Thane has sentenced a 26-year-old fisherman to two decades of rigorous imprisonment for repeatedly sexually assaulting a minor. The fisherman had promised marriage to the victim, a domestic help, knowing he was already married with two children. This deception, which began in August 2022, continued until September 2023, resulting in the victim's pregnancy.
When confronted about the pregnancy, the accused revealed his marital status and refused responsibility, issuing threats. The victim subsequently underwent a medical termination of pregnancy at 22 weeks. The court highlighted that the victim's consent was secured through fraud, classifying the acts as rape under Section 375 of the IPC.
Judge Ruby U Malvankar convicted the fisherman under the POCSO Act and sections of the IPC for aggravated penetrative sexual assault, repeated rape, and criminal intimidation. He was sentenced to 20 years for the POCSO offense and fines for the IPC charges, with sentences to run concurrently.
