Summary
- Vacation court hearing mother's challenge to family court's custody order
- Father granted 2-hour weekly access, but lost 5 days of access
- Child unwilling to stay with father, family court did not consider child's wish

On October 25, 2025, the vacation court is hearing a mother's challenge to a family court order granting the child's interim custody to the father from October 17 to October 23. Pending their divorce proceedings, the estranged couple had signed consent terms by which the father was given access to the child for 2 hours every Saturday in the family court's child complex.
However, the wife's advocate now says the mother is not comfortable granting the father access to the child for such an extended period, especially overnight. The advocate added that the condition that the mother-in-law should not be at home during the child's stay with the father is reasonable and in the child's interest. The child is also not willing to be with the father, and the family court did not consider the child's wish, the advocate argued.
In response, the child's father said the condition is most unreasonable, and he cannot keep his mother outside the house during the child's stay with him. He informed the court that he was not given access to the child and lost five days of access. The vacation court judge, Justice Jamsandekar, noted that the family court had considered all the facts and circumstances in granting the father's application for access to his son. The judge concluded that he found no substance in the wife's submissions.
