Google Engineer Bets Against Law: Insider Trading or Gambling?

Michele Spagnuolo, a Google engineer, has been arrested for alleged insider trading on the prediction market platform Polymarket. Spagnuolo, who was living in Zurich, Switzerland, faces accusations of commodities fraud, wire fraud, and money laundering. His legal team has filed a motion to dismiss the charges, asserting that his wagers, which allegedly yielded over $1.2 million in profits, were acts of gambling and not subject to US commodities law.

Spagnuolo's defense team argues that classifying these wagers as financial instruments would have absurd implications. They contend that the US government lacks jurisdiction due to Spagnuolo being a non-US citizen and Polymarket's operations being based offshore, despite its New York headquarters. This legal battle is part of a larger national debate concerning whether prediction market contracts should be regulated as swaps under the Commodities Exchange Act or as gambling under state laws.

The case is compared to that of Gannon Ken van Dyke, another individual charged with insider trading on Polymarket. Van Dyke's defense also frames his activity as gambling, not subject to federal commodities law. The Commodity Futures Trading Commission (CFTC) maintains that these prediction market contracts are indeed swaps. This legal showdown is expected to escalate, potentially reaching the Supreme Court and fundamentally defining the future of prediction market regulation.
