In Minnesota, Jesse Kowalczak, 22, was sentenced to just one year in jail and five years of probation for causing a fatal crash. The collision occurred on May 13, 2022, near Duluth, resulting in the death of 48-year-old Leah Sarko and severe injuries to her 11-year-old son, Evan. Kowalczak admitted to driving between 72-89 mph on a road with a 40 mph speed limit during heavy fog.
Kowalczak, who was 18 at the time, pleaded guilty to criminal vehicular homicide. His vehicle struck Sarko's car as she was turning, causing it to flip. Sarko died at the scene from blunt-force trauma. Evan suffered a concussion and broken bones, requiring weeks in a wheelchair.
Judge Nicole Hopps imposed a unique sentencing structure, with Kowalczak serving 364 days in jail in five separate 73-day stints on the anniversary of the crash. He was also ordered to perform 60 hours of community service annually and give at least six educational talks per year about the dangers of reckless driving.
Kowalczak's defense cited his youth, lack of prior record, and community support. He expressed remorse, stating he wished it had been him instead of Sarko. The family has filed a civil wrongful death lawsuit against Kowalczak and his parents, which remains pending. A GoFundMe for the Sarko family exceeded its fundraising goal.
