A carer has received a sentence of 100 days of unpaid work after a fatal medication error at Wheatridge Court Nursing Home. Jane Barnard, 67, administered a large dose of slow-release morphine to resident Derek Davies, 75, on September 6, 2021. Barnard, who had worked at the facility for over three decades, failed to follow correct procedures when retrieving and administering the controlled drug.
Barnard admitted to wilful neglect but was acquitted of manslaughter by a jury. The court heard that she realized her mistake after Mr. Davies became unwell, subsequently disposing of his correct medication and failing to inform paramedics of her error. Mr. Davies tragically died two days after the incident due to morphine toxicity.
While described as a caring individual with genuine remorse, Barnard's actions led to severe distress for Mr. Davies' family, who called the experience traumatic. The judge acknowledged her conduct stemmed from panic and noted her suspension from work. The case highlights the critical importance of medication protocols in care facilities to prevent similar tragedies.
