The Mumbai Sessions court recently upheld the conviction and sentence of Bollywood producer Abdul Samee Siddiqui concerning a cheque bounce case. Siddiqui, who has produced notable films, had appealed the Bandra Magistrate court's 2019 order. That earlier ruling imposed a one-month simple imprisonment sentence and ordered compensation to the complainant.
The case originated from a monetary dispute where the complainant invested Rs 5,50,000 with Siddiqui's company, Sunrise Picture Private Limited, allegedly for a doubled return within 30 days. A cheque issued by Siddiqui to discharge this liability bounced due to insufficient funds in July 2013.
Despite the company's acquittal on a technicality regarding demand notices, Siddiqui's individual conviction was upheld. The court rejected the defense's claim of insufficient documentary proof for the cash transaction, emphasizing the statutory presumption of a legally enforceable debt under the Negotiable Instruments Act.
