A federal judge has largely dismissed Alec Baldwin's civil rights lawsuit against prosecutors in the "Rust" case. Judge Kea Riggs found that Kari Morrissey and other prosecutors involved are shielded from liability due to absolute prosecutorial immunity.
The ruling stated that while the alleged misconduct is disturbing, protecting prosecutors from constant dread of retaliation is paramount. Baldwin had sued, alleging an "out-of-control prosecution" following the 2021 accidental shooting of cinematographer Halyna Hutchins.
Baldwin's involuntary manslaughter trial was dismissed earlier in July 2024 after evidence was withheld. His suit also targets Santa Fe County and investigators, with rulings on those claims pending.
Some claims against prosecutor Morrissey, specifically those related to her alleged failure to disclose evidence and mishandling of bullets, will proceed.
