Summary
- Man sentenced to eight years for fatal assault in 2018.
- Court found intent to kill was not proven.
- Co-accused acquitted due to benefit of doubt.
In Kalyan, a court recently sentenced Pravin Mukane to eight years of rigorous imprisonment for culpable homicide not amounting to murder. The conviction stems from a fatal assault that occurred in Badlapur on the night of November 7, 2018.
The court determined that while Mukane's role in the assault was established, the prosecution could not prove the intent required for a murder charge. Consequently, he was convicted under Section 304(II) of the IPC, rather than the original Section 302.
During the altercation, the victim, Rajesh Waghe, sustained a fatal head injury. Mukane was given credit for time served since November 8, 2018. Separately, co-accused Satyawan Waghe was acquitted of all charges. The court also directed compensation for the victim's dependents.
