16 Jun
Summary
- Federal judge dismissed xAI's trade secret lawsuit against OpenAI.
- xAI failed to prove OpenAI improperly obtained confidential information.
- This is the second legal defeat for Elon Musk against OpenAI.

A federal judge has dismissed xAI's trade secret lawsuit against OpenAI. U.S. District Judge Rita Lin concluded that xAI did not sufficiently prove that OpenAI encouraged a former xAI engineer to disclose confidential information during the recruitment process. The judge stated that simply inquiring about a candidate's past work is a routine hiring practice and does not equate to inducing the disclosure of trade secrets.
This decision marks the second legal defeat for Elon Musk in his ongoing conflict with OpenAI and CEO Sam Altman. Previously, a federal jury rejected Musk's $150 billion lawsuit, which alleged that OpenAI had abandoned its founding mission. The dismissed lawsuit centered on claims that OpenAI targeted a former xAI engineer for his work on Grok 4's systems, seeking confidential details during his recruitment presentation.
