- The lawsuit claims Lilly used outdated data for comparative efficacy claims.
- Novo seeks to bar Lilly's ads and recover profits from them.

Novo Nordisk has initiated legal action against its competitor, Eli Lilly, alleging deceptive advertising practices concerning their respective weight-loss and diabetes medications. The lawsuit, filed in a New Jersey court, claims Lilly's promotional campaigns contain "deliberately false" statements about the comparative efficacy of their drugs.
Specifically, Novo Nordisk asserts that Eli Lilly has cited outdated clinical trial data to promote its obesity drug, Zepbound, as yielding greater weight loss than Novo's Wegovy. Furthermore, Novo claims Lilly's advertisements inaccurately portray its diabetes medication, Mounjaro, as superior to Novo's Ozempic in managing blood sugar levels.
Novo Nordisk is seeking a permanent injunction to halt these advertisements and to have Lilly pay damages equivalent to any profits gained from the allegedly misleading campaigns. The company's general counsel stated that a prior cease-and-desist letter to Lilly received no response, leading to the lawsuit.
This legal dispute escalates the intense competition between the two pharmaceutical giants in the rapidly growing market for obesity treatments. Both companies are also rolling out new oral weight-loss pills, aiming to capture a larger share of this lucrative market.
