Nintendo Sued Over Trump Tariff Refunds

Nintendo of America is facing a proposed class action lawsuit filed on Tuesday, demanding that the company pass tariff refunds, originating from the now-voided Trump administration duties, onto its customers. The suit, lodged in the US District Court for the Western District of Washington, asserts that Nintendo has not committed to refunding consumers for these duties.
The plaintiffs allege Nintendo stands to profit by collecting tariff payments twice: once through potentially higher consumer prices and again via government refunds with interest. Nintendo increased prices on accessories by $5 to $10 in April 2025, and later hiked the cost of Switch hardware.
This legal action follows the US Supreme Court's February 2026 decision that struck down the Trump-era tariffs, deeming them unauthorized. The government had collected over $160 billion from various companies, including Nintendo. Lawsuits seeking similar consumer refunds have also targeted EssilorLuxottica and Lululemon.
