OpenAI Remains in Musk's Antitrust Battle
14 Sep
Summary
- Musk's companies X and SpaceXAI settled antitrust claims against Apple.
- The lawsuit accused Apple and OpenAI of monopolizing AI and smartphone markets.
- OpenAI is still a defendant and seeks details of the Apple settlement.

Elon Musk's X Corp and SpaceXAI have settled their antitrust claims against Apple, resolving one part of a larger lawsuit that accused Apple and OpenAI of monopolizing generative AI and smartphone markets. The companies filed a motion on Monday to dismiss their claims against Apple with prejudice, a move Apple did not oppose.
Despite this resolution, U.S. District Judge Mark Pittman has kept the claims against OpenAI active. The original lawsuit, filed last year, alleged that Apple’s integration of ChatGPT into its devices violated antitrust laws, thereby boosting OpenAI’s market position and stifling competition.
OpenAI, not privy to the Apple settlement discussions, has requested the agreement’s details, arguing it is crucial for its defense. The AI company has sought a 14-day extension to file a motion for summary judgment, indicating the settlement's terms could significantly impact its legal strategy. While X and SpaceXAI agreed to the extension, they have not yet agreed to produce the settlement document, prompting OpenAI to consider seeking court intervention.
