India is undergoing a significant transformation of its labor laws with the introduction of new, simplified codes. These reforms aim to create a more transparent and uniform framework for wages, social security, and working conditions across all industries, enhancing worker protection while facilitating business operations.
The new codes standardize minimum wages for all employees, including those in unorganized sectors, and establish a statutory floor wage. They also ensure gender equality in pay for similar work and mandate overtime compensation at double the normal rate. Furthermore, offenses that previously carried imprisonment will now be met with monetary fines, and thresholds for lay-offs and retrenchments have been raised to protect employment.
Key provisions also include social security benefits for gig and platform workers, funded partly by a turnover tax on aggregators. Fixed-term employees will receive pro-rata gratuity, and a new inspector-cum-facilitator system with randomized inspections is being implemented to prevent harassment. Digitization of compliance processes and the mandatory issuance of formal appointment letters are also central to these modernizing efforts.
