A noise dispute between Perth Day Hospital and Fitness Cartel has escalated to the Supreme Court of Western Australia, leading to the gym's temporary closure. The hospital, located below the gym in Osborne Park, claims that excessive noise from music and dropped weights since the gym's opening in November 2025 is causing vibrations that disrupt its sensitive medical procedures, including spine and nerve treatments.
Following unsuccessful attempts to resolve the issue, the hospital obtained an urgent injunction on May 30, 2026, restricting the gym's operations. This order prohibited low music and the use of weights during hospital treatment hours. Two days later, the gym sought to modify these restrictions, citing significant financial losses and reputational damage.
However, Justice Michael Lundberg refused the gym's request and brought the trial forward to July 13, 2026. The judge also agreed to personally inspect the Osborne Park property on the trial's first day.
