GST: Free Samples, Expired Meds May Get Input Tax Credit
5 Oct
Summary
- Input tax credit on free samples and expired medicines could be allowed.
- GST exemptions may extend to imported medicines for rare diseases.
- Clinical trials for foreign clients may be treated as exports.

Several proposals are under consideration to amend India's Goods and Services Tax (GST) framework. One significant potential change involves allowing input tax credit (ITC) on items such as free samples and expired medicines, which could offer relief to businesses.
Another reform being discussed is the extension of GST exemptions. This would cover imported medicines and specialized foods designated for seven rare diseases, thereby improving access for affected individuals.
The proposals also aim to reclassify certain services for tax purposes. Work conducted in India for overseas clients, including contract manufacturing and clinical trials, might be treated as exports. This reclassification could significantly reduce the tax burden for Indian contract research organizations (CROs) serving international pharmaceutical and biotechnology companies.
These changes, if implemented, would align India's GST structure more closely with international practices for export-oriented services and specialized medical needs.
