The dispute originated in 1963 when M/s RC Sood & Company Ltd sold two plots to Nanki Devi. Despite advance payments, possession was never granted due to various legal and regulatory hurdles that spanned decades. The developer's attempts to dismiss the claim were rejected by the court.
Justice Deepak Gupta's ruling highlighted that parties cannot use market escalation as a defense for decades of delayed performance. This landmark judgment brings closure to one of the region's longest-standing property cases, reaffirming the allottee's rights after significant legal proceedings.
